Terms of Service

1. Introduction

This Terms of Service agreement outlines your rights and obligations when using our services. By accessing or using the services provided by Cloudnovi BV, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

2. Account and Data

You are solely responsible for the data and content stored in your hosting account and services. Regular backups are encouraged, though we also maintain periodic backups for disaster recovery purposes.

3. Service Restrictions & Abuse

Users are prohibited from using our services for the following activities:

Failure to comply may result in suspension or termination. Customers are required to respond to abuse requests within 48 hours. Abuse reports: abuse@kgb-hosting.com.

Hosting or distributing malicious or copyrighted content (DMCA)
Hosting pornographic content of any kind
Hosting content related to gambling
Hosting network stressers, booters, botnets, or DDoS/probing tools
Spam activities through mail or other communication
Using cracked software or software without proper license
Hosting public proxies, TOR relays, or TOR exit nodes
Hosting cryptocurrency mining software
Using fake players or bots to inflate game server player counts
Any illegal activity or unauthorized access attempts
Using services to infringe on rights of others

4. Payment and Billing

All payments are processed in EUR. If paying in a different currency, conversion rates and fees may apply.

You agree to automatic billing using the payment method on file and must keep billing information up to date.

Service cancellation must be done before the end of the current billing period. Hosting accounts are auto-renewed by default.

Filing chargebacks without first contacting billing is considered a violation. Accounts can be suspended during investigation and may be terminated if disputes are fraudulent.

5. Account Eligibility & KYC

You must provide accurate, current, and complete registration details. Accounts with false or incomplete information may be suspended or terminated.

We reserve the right to perform KYC verification. Stripe Identity is used for verification workflows.

6. Support and Service Level

Our support team assists with hosting-related queries and aims to respond within one business day.

Services are unmanaged and we do not provide support for third-party software.

7. Customer Modifications & Liability

Customers are responsible for modifications to services, including binaries, plugins, mods, and configuration changes. We are not liable for issues caused by customer-initiated modifications.

8. Right of Withdrawal & Refund Policy

By placing an order and explicitly consenting during checkout, the customer requests immediate digital service delivery and waives the EU 14-day right of withdrawal for digital services. Instead, a limited refund request may be submitted within 48 hours of service delivery.
